To Refinance or Not to Refinance?

big question markMany homeowners are tempted to refinance at interest rates that haven't been this low since the 1970s.

Well, should you? Or shouldn't you?

The general rule of thumb has been to refinance if you can save more than 1% on the rate (with no points or fees other than an appraisal, Title Insurance, and re-establishing an escrow account). You also generally want to be planning on staying in the home for at least another few years, as it will usually take a year or two to recoup those costs. (MORE, if you pay origination fee and junk fees.)

I read an interesting article today by a Dr. Steve Sjuggerud who gives contrarian wealth-building advice.

His recommendation is that "The last person you want to get your interest-rate forecast from is your real estate agent!"

I would agree. Most real estate agents (including myself) simply cannot forecast the interest rate. I highly doubt that Dr. Sjuggerud can forecast the interest rate either (with any specificity), but let's hear what advice he would give you:

  • He suggests that mortgage rates could go "much lower".
  • He plants seeds that suggest that he thinks you should hold out for 3% or below.
  • He recommends refinancing into an Adjustable Rate Mortgage (ARM) and then switching to a 30 year fixed rate once the Fed raises the short term rate.

The only problem with his strategy, (OK, maybe not the only problem, but a real one and a big one for consumers to consider) is that if your property value declines (Sorry, but you have heard that most of the country is in a declining market, right?), you may not be able to refinance into that 30 year fixed rate mortgage...

That's exactly the problem with Arizona's real estate market right now. Property values are downfrom their peak at up to 50% in some markets. No lender will loan you 200% of what your home is worth... so very few owners can take advantage of today's rates.

As "bad" as 5% might seem to Dr. Sjuggerud, many people have 6, 7, 8 & 9% mortgages right now. Many of those people are on ARMs, just like this guys suggests! Those whose property values have declined significantly cannot refinance into today's "terrible" 5% rate.

I'm not saying that rates won't go lower... I hope they do!

But be aware that waiting to refinance as property values decline may not be the smart decision. Getting into an ARM while property values are on the decline might not be the smartest thing to do... even if rates do dip lower.

In some markets, waiting for that 3% rate might just keep you from being able to refinance your home at all. And if the rate does get down that low, why not refinance again? If you can't, you wouldn't have been able to if you had waited... so you don't really lose.

Get a good idea of what the property values are doing in your area, evaluate your current rate and the current options you have to refinance. If the rate isn't low enough for it to make sense... don't do it. If it is, why wait for something that may or may not happen?

$6,000 Utah Grant for New Construction Not Just for First Time Homebuyers - Does Not Have to be Repaid

The State of Utah is offering purchasers of new construction a $6,000 grant that does not have to be repaid. You do not have to be a first time home buyer to qualify, but there are a few limitations.

Here are the basics of the "Home-Run" grant:

Does the amount of the grant vary? Is it up to $6,000? No. The amount of the grant for qualified applicants will always be the full $6,000.

Does it have to be re-paid? No. The $6,000 grant does not have to be re-paid.

Do I have to live in the home? Yes. The grant is for owner-occupied transactions. You must move into the home as your primary residence within 30 days of closing.

Do I have to be a first-time homebuyer? No. You need only to purchase a newly constructed home that has not yet been lived in.

Where did the money come from? From the Federal stimulus money given to Utah.

Are there income limitations to qualifying? Yes. A single Buyer cannot earn more than $75,000 per year and a couple that files jointly cannot earn more than $150,000 combined.

Does taking this grant disqualify me from the $8,000 Federal Tax Credit being offered by the Federal Government? No. There is an up to $8,000 federal tax credit for first time homebuyers who purchase a home between January 1, 2009 and December 1, 2009. (Details here) If you qualify for the $8,000 tax credit, you probably qualify for the $6,000 grant and can receive a total of $14,000 in credits/grants if you purchase new construction in Utah.

How long does this program last? While supplies last. There are only about 1600 grants available and once they are gone, they are gone for good.

Why the $6,000 grant? Lawmakers believe that this will help move some of the over 2,000 completed new construction homes on the market that are currently unsold.

How do I receive the money? When you have identified a property, your lender can submit the paperwork to reserve one of the grants available. At closing, $6,000 will be wired to the title company to be used on your behalf. It can be applied toward closing costs, fees, even down payment.

Are there any other restrictions? You must purchase the home with a 30 year (or less) fixed-rate mortgage. (FHA, VA, Utah Housing, Conventional are all options)

An Equal Level of Representation for Home Buyers

Exclusive Buyer Agency (EBA)Great Article in the New York Times Friday, featuring a good friend and colleague of mine, Ira Freireich of Long Island, NY.

The article points out how many homebuyers are becoming more savvy and aware of how they can get the best level of representation in the real estate transaction: Exclusive Buyer Agency.

Some key points:

  • Exclusive Buyer Agents (EBAs) negotiate for the Buyer
  • EBAs work for the Buyer only - Not the Seller like traditional real estate agents
  • EBAs keep confidential information confidential - The seller won't know that you can or will pay more
  • EBAs give you more control - They have no specific properties to push on you

Dual Agency, Bad for Buyers (And Sellers!)

A true agent only works for a buyer or a seller. Not themself.When I first began my career in Real Estate, I observed agents as they asked consumers to agree to dual agency. Sellers are often asked to do so when they list the home. Buyers are often asked to do so when writing an offer.

When taking a listing they may have said something like:

Initialing here allows me to bring a Buyer for your home.

When writing a contract with a Buyer, they may have said something like:

Initialing here allows me to help you with the paperwork to buy this home.

No discussion whatsoever about what fiduciary duties a Seller or Buyer may be giving up when they initial or sign the documents.

While the definition of Agency Relationships varies from State to State, that doesn't mean that proper disclosure of what a Buyer or Seller loses by agreeing to dual agency should not take place by every licensee.

I believe that if most of the public were truly educated well about what they lose in a dual agency relationship, many fewer, if any, consumers would consent to a dual agency relationship.

A true agent only works for a Buyer or a Seller... NOT themself.
