The Most Personal Property Included in a Transaction

tvAnybody want to fight to claim to have had a transaction with the most personal property included as part of the sale?

I know I don't even come close because typically we seek to NOT have any personal property included as part of a transaction. Often, asking for personal property can hurt you in negotiations.

Well, a recent transaction set my mind on this because a lot of personal property was included in the sale of the home. Most was offered up front as an incentive to Buyers, but we had additional things get added along the way when there were repair issues that the Seller didn't want to take care of. (And there were many that they DID take care of!)

Anyway, among some of the included property we had such things as a flat screen TV, Home theatre equipment and a microfiber couch. We also got gift cards from home improvement stores, a swingset, a tuffshed, and on top of everything else, I rebated back to the Buyer the money paid to our brokerage by the listing brokerage that was above and beyond the fee we contracted with our buyers. This is all on an entry-level existing home.

One funny thing about the transaction is that they wouldn't take the microfiber couch even if we didn't want it. They brought it into the basement through an old window a year or two back. Then, the Seller upgraded all the windows and the only way to get the couch out would be to saw it in half! (Or take out the big window again...)

Anyway, I've strayed...

None like that.  I sold a farm recently...but I let the buyer and seller do the personal property...well over $100K with equipment and animals and other things.

Benjamin..... Interesting story... Where did the couch Stray to ?  Oh was that it stayed...... I'm sure it would have been hard to remove... WoW.. the sellers should have measured the couch and the new windows to see if they could remove it if needed.

Ben, in 1995 I bought a house and told the owner she didn't have to remove anything that she didn't want.  Then I asked to close in 20 days.  The house was a fire trap and she had lived there for about 50 years and the same family long before that.  She did take the antique secretary desk but she left enough other stuff  to fill a dumpster. I planned to gut the house anyway.  She also left most of the furniture, toys that were 60 to 70 years old and lots of other mostly small items with value as antiques.  I looked at everything before tossing it - especially after I found an envelope with a $100 bill in it and a couple silver sollars from the late 1800s (only worth about $25 each).  I even got a couple of those old style wooden trunks you see in antique stores now and then. 

 

The value of the stuff she left probably made the clean up worthwhile but the real value was- if she had to clean it out she never would have accepted my offer.

So THATS why so many people came to my yard sale.  I did see a couple pieces that I sold in an antique store a couple weeks later.

 

If only I had waited for Antiques Road Show...but I think it was a couple years later when it came to Philly.

Almost all the properties we sell include most of the furniture as we are vacation sellers, and no one wants to move things or pay to store them, so like it or not this (gunk) stuff stays, but issues come up over  little stuff.

Most of the condos that are sold here are rental properties are sold fully furnished  with dishes, pots, pans etc.

I have never really had a transaction with a lot of personal property conveying.  Though I was amused when I represented the buyers on a transaction for  lovely home in a gated golf community, and they called the day after they moved in to complain that the stepping stones had been removed from the side of the house.  They wanted them back.  They were just flat stepping stones.  Nothing special.  Why bother?  Then again, it makes you wonder why the sellers took them?  Very odd.

Ben,

Interesting dilemma.  In Breckenridge many of our condos are sold furnished because they are rental properties held as investment properties.  Had a condo buyer who received an accepted offer on a condo that was fully furnished.  Then the Seller said he wanted to keep the dining room table because it was a family heirloom and a rug that was a gift along with a wall hanging.  I thought the deal might go South, but I did negotiate for the Buyer a $10,000 credit at closing to replace those items.  That was a lot for those but I convinced the Seller that the high price on the condo was worth more then the 10K credit.

Typically I write in my contracts when there is personal property that it will be conveyed by a separate bill of sale for $10.00 and I make sure that is shown on the Settlement Statement.  If you would like my exact wording let me know and I will forward it to you.  Great Story!!!
